Appeal Rejected Despite Alleged Lawyer Misconduct

An Illinois appeals court overturned a decision that allowed a convicted felon to file a late appeal because the defendant failed to prove insufficient assistance his lawyer.

Defendant Darius Moore filed a motion for post-conviction relief, in part alleging that his trial counsel was ineffective for failing to advise Moore. on the right to appeal the conviction and sentence. The appeal panel said the court erred in accepting the request because the judge properly advised Moore of his right to appeal the sentence, and Moore’s attorney should not repeat this to his client.
